Bill* – Debts
Bill* was referred to the Law Centre by a friend after he received notification of a Simple Procedure claim against him in relation to a catalogue debt from 7 years before this.
Problem
We wrote to the solicitor firm acting on behalf of the catalogue company and requested information on the account including a statement of account. When this was received it was clear the debt was time-barred and we submitted this as a defence to the court. The claimant refused to accept that the case was time-barred.
Solution
When the case was heard in court it was explained to the Sheriff that the account was last used or paid towards over 7 years prior to this and the Sheriff agreed that the case was in fact time-barred and the case was dismissed.
