Louise* – Benefits

Louise* approached the Law Centre for assistance with challenging a DWP decision regarding her Personal Independence Payment.

Problem

She had been in receipt of High Rate Care and Mobility on Disability Living Allowance however, when she was converted to PIP she was awarded 0 points for both components. Louise suffers from a learning disability and this affects her on a daily basis. We challenged the decision by Mandatory Reconsideration first but to no avail.

Solution

We continued to appeal and the tribunal panel awarded Louise the enhanced rate of both components for an indefinite period of time as her disability is lifelong and will not improve. The stress of reviews of her benefits deeply upsets Louise and the fact we were able to achieve a lifelong award for her means she will not have to go through the stress of having her PIP reviewed.
