Tony* – Eviction

Tony* contacted the Law Centre around 4.30 pm on a Tuesday afternoon to seek our help as he was being evicted the following morning at 10 am.

Problem

Tony’s wife was in the hospital having given birth to premature twins which only added to Tony’s stress. We ascertained that he was not represented at any court hearings in relation to this and therefore we made an application to recall the Decree. This was done and served by 10 am the next day.

Solution

Between then and the court date we worked with Tony and his wife to maximise the income into the house by applying for benefits to which they were entitled but not aware of. We also made an application to the Hardship Fund and the client was awarded a sum which cleared the arrears in full. When the case called in court it was dismissed and there was no negative impact on Tony’s credit file and the family had a roof over their head.
